This Privacy and Cookie Statement describes how eValetudo, trading under the name of SeeMe-nopause (‘SMNP’), a private company with limited liability, having its registered office at Bijster 18, 4817 HX Breda, the Netherlands, registered in the Commercial Register under number 82960496, collects and processes your personal data and uses cookies and other techniques on the website www.seemenopause.com (‘Website’). 

Data processing 

Privacy-sensitive data, or personal data, is processed through SMNP. SMNP considers the careful handling of personal data to be of great importance. Personal data is therefore carefully processed and secured by us. This means, among other things, that:  

  • we clearly state the purposes and bases based on which we process personal data in this Privacy and Cookie Statement;  
  • we restrict the collection of personal data to only the personal data necessary for legitimate purposes;  
  • we always ask for your explicit permission to process your personal data in cases where your consent is required;  
  • we take appropriate security measures to protect your personal data and also require this from parties that process personal data on our behalf;  
  • we respect your right to provide your personal data for inspection and have your personal data corrected, deleted or transferred at your request, as well as your right to object to the processing of your personal data and your right to restrict the processing of your personal data.  

SMNP is responsible for the data processing. In this Privacy and Cookie Statement, we explain which personal data we collect and use and for what purpose. 

Personal data we process  

We collect data you provide when you register for our newsletter, create an account, place an order, contact our customer service or participate in an (interactive) function on our Website. The data collected may be personal data. We only keep and use the personal data provided by you directly in the context of the service you requested, or of which it is clear that it is provided to us to process.  

We use the following data for the purposes stated in this Privacy and Cookie Statement:  

  • Name and address details  
  • Telephone number  
  • Invoice and/or delivery address  
  • E-mail address  
  • Payment data (bank account number)  
  • Date of birth  
  • Technical data such as IP address  
  • Medical data 

Purposes and bases of data processing  

We collect and process your personal data for the following purposes:   

  • granting access to the Website and your personal account on the Website;  
  • creating an account, providing services and communicating with you;  
  • informing you (digitally) about menopause issues and related topics;  
  • organising, handling and checking the order that you have placed;  
  • enabling the independent doctors or healthcare professionals to whom we have access to provide you with an online consultation on request;  
  • enabling independent pharmacies to which we have access to sell and deliver the requested or prescribed products;  
  • carrying out an ID check, if necessary;  
  • conducting analysis and research to improve our services and Website;  
  • analysing your online (browsing, searching and/or purchasing) behaviour when you visit or use our Website, in order to provide you with targeted information (profiling).  

The above is based on your explicit consent to process your data, unless your explicit consent is not required because the data is processed in the context of the conclusion and/or performance of a contract, compliance with a legal obligation, to protect a vital interest of you and/or a legitimate business interest of us.  

The doctors and pharmacies affiliated with SMNP perform their work independently of SMNP. For the purpose of requested online consultations and the delivery of requested or prescribed products, SMNP shall collect and keep your medical and other personal data for the doctors and/or pharmacies, and shall share this data with them. SMNP employees do not have access to this medical information. Your personal data is only accessible to the treating doctor and the delivering pharmacy, who are independently responsible for the data processing. We have made agreements with these doctors to safeguard your privacy and other rights.  

Customer service contact  

On our Website we offer the opportunity to contact our customer service (by telephone or other means) if you have any questions. You are asked to provide some details to be able to answer your question. You choose which details and data you provide. The data you provide will be kept as long as necessary for the full answering and handling of your question.  

Newsletter  

We offer a newsletter with which we want to inform interested parties about SMNP in a broad sense and about our services. You have to explicitly subscribe (opt-in) to receive the newsletter. We process the following personal data for sending the newsletter:

We use this data on the basis of your consent. You can unsubscribe from the newsletter at any time. Each newsletter contains a link with which you can unsubscribe.  

Publication and transfer to countries outside the EU  

We do not publish your personal data. Although SMNP tries to avoid this as much as possible, your (personal) data may be transferred to companies in countries outside the European Union. In such cases, SMNP will require these companies to provide an adequate level of protection to ensure that your personal data is protected as well as possible.  

Transfer to and processing by third parties  

In some cases, we transfer your personal data to third parties (‘processors’) and companies affiliated to SMNP to organise, manage and monitor rights and obligations – including services and payments arising from the contract concluded with you. We have concluded agreements with the aforementioned third parties, in which we ensure that the further processing of personal data by these third parties also complies with the applicable privacy legislation.  

Security  

We take security measures to limit abuse of and unauthorised access to personal data. In particular, we take the following measures:  

  • access to personal data is protected with a username and password;  
  • we take physical measures for access protection of the systems in which personal data is stored;  
  • our technical equipment and infrastructure suppliers comply with applicable ISO standards;  
  • we use secure connections (Secure Sockets Layer or SSL) which protects all information between you and our Website when you enter personal data.  

Retention period  

The personal data described above is retained as long as your account has an active status. Your account – including the associated personal data – will be deleted by SMNP if the account hasn’t been logged into for three years, if it has been three years since you last placed an order through SMNP, or if you request us to delete your personal data or account. Certain personal data will be retained for a longer period if there is a legal obligation to do so (such as the fiscal retention period of at least seven years for payment data and at least 15 years for medical data).  

Your rights  

You have the following rights under the General Data Protection Regulation (GDPR):  

  • the right to inspect your personal data that we process;  
  • the right to correct or complete your personal data that we process if it is incorrect or incomplete;  
  • the right to withdraw previously given consent;  
  • the right to object to the processing of your personal data;  
  • the right to have your personal data deleted;  
  • the right to have your personal data that we process transferred to a third party;  
  • the right to restrict the processing of your personal data, meaning that we will process less personal data from you.  

You can exercise the above rights and any other rights that you have under the applicable privacy laws by sending a request to our Data Protection Officer, whose contact details are at the end of this Privacy and Cookie Statement.  

Reporting of incidents, security incidents and data leaks  

If, despite of the protective measures taken, your personal data is breached or we suspect it may be breached, we will notify the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) thereof. If the personal data breach is likely to have adverse consequences for you, we will communicate this to you as soon as possible. SMNP has an internal procedure in place for dealing with such incidents.  

Cookies  

SMNP uses cookies. Cookies are small data files that are stored on your computer or mobile device when you visit the Website. Cookies contain information about, for example, your browser settings. This allows us to distinguish you from other visitors. We and third parties use cookies:   

  • to enable functionalities of the Website (technical and functional cookies);  
  • to analyse the use of the Website and make the Website more user-friendly (analytical cookies).

We use these cookies to collect statistics from users of the SMNP Website. They help us to improve the Website. The cookies collect information about the way visitors use the Website, including information about the most visited pages or the number of displayed error messages. This enables us to make the structure, navigation and content of the pages of the Website as user-friendly as possible for you. The statistics and other reports do not contain identifiable personal data.  

We use Google Analytics to keep track of how visitors use the Website. We have entered into a processing agreement with Google to make agreements about the handling of our data. Furthermore, we have not allowed Google to use the obtained Analytics information for other Google services. Finally, we have the IP addresses anonymised.
